The City Council of the City of East Palo Alto is submitting to the voters the question of whether to approve an increase ofthe City’s Transient Occupancy Tax(“TOT”).

The tax is paid by a person who rents a hotel roomin East Palo Alto. If approved by the voters, Measure V would increase the City’s existing TOT tax of twelve percent (12%) by one percent (1%) on January 1, 2022 and another one percent (1%) on January 1, 2023, for a total tax of fourteen percent (14%). Revenue generated from this additional 2% special tax can only be used for the following purposes:

Affordable housing development, acquisition, and/or rehabilitation, including but not limited to, acquiring at-risk or vacant properties, rehabilitating deteriorating units, preventing displacement and creating more affordable rental and homeownership opportunities.

A maximum of 15% of the new tax revenue maybe used for staff and overhead costs.The additional 2% tax revenue cannot be used for any other purpose. It is estimated that the additional tax will generate $195,000 inthe first year, and $390,000 annually thereafter.

If approved, the additional 2% special tax from this Measure shall be deposited into a special fund. City staff will be required to providethe City Council anannual report that states the funds collected and theirexpenditureThe Measure would also make administrative changes, including but not limited to:

Amending the definition of "hotel" toinclude homes, apartments, condominiums, and townhouses.

Changing the measure of the tax from the rent charged by a hotel to the rent paid by a transient

.Requiring a "rental agent" defined as a person other than a hotel operator who collects rent from a transient for the transient's occupancy of a hotel to collect, report,and remit the tax.

Designating the City Manager to hear appeals of any decision of the tax administrator with respect to the amount of applicable tax, interest, and penalties.

Requiringany claim for refund of a tax, interest,or penalty be submitted in writing within one year of thedate of payment.

The tax imposed by this measureshall not expire unless ended by the voters of East Palo Alto. Measure V authorizes the City Council to amend the ordinancewithout voter approval, provided such amendment does not increase the amountof tax paid by any taxpayer in excess of the rate set forth in the Measure.

To be adopted, Measure V must be approved by a 2/3 majority of the voters voting on the measure.

A “yes” vote on the Measure will approve a 2% increase to the TOT tax.

A “no” vote on the Measure will rejecta 2% increase to the TOT tax.

Arguments FOR

Vote Yes on Measure V to preserve our homes and ensure our residents have a stable place to call home.  The Great Recession and foreclosure crisis of 2007-2009 greatly impacted our community as many of our community members lost their wealth and were displaced.  Measure V will help us prevent that from happening again.

Measure V enacts a modest 2% increase in the Transient Occupancy Tax (TOT) paid by out-of-town visitors staying in East Palo Alto hotels and short-term rentals.  The tax will be phased in over a two-year period with a 1% increase in 2022 and another 1% increase in 2023. The tax is paid by hotel and short-term rental customers.

Local residents and property owners will NOT pay the tax.

Preservation is key to preventing displacement. Keeping existing housing affordable for East Palo Alto residents enables long-time community members to stay here.  It also makes housing accessible to families with modest or fixed incomes so they too can remain in East Palo Alto.

Measure V will:

 - provide an estimated $195,000 annually dedicated to affordable housing acquisition, development, and/or rehabilitation

 - make funding available to tenants to, with City and non-profit assistance, buy a house or apartment building about to be sold

 - create more affordable rental and homeownership opportunities

Our TOT of 12% has not been raised in over twenty years, since voters adopted it in 1998. It's time to increase the TOT to be in alignment with other cities in our region that have TOTs of 14% or higher.

Please join a unanimous City Council, as well as community and business leaders, and vote Yes on Measure V.

Arguments AGAINST

East Palo Alto currently imposes a 12% Transient Occupancy Tax (TOT) on guests in the hotels, motels, and inns here. Now the City Council is proposing another  tax increase up to 14%.

The City Council wants people who do not live in East Palo Alto and largely do not use city services to pay for the services used by businesses and homeowners who do live and work here in East Palo Alto.

In other words, they want a free ride and stick out of towners with the bill.

Would you do that to your friends, family, or co-workers?

No, because that would be immoral.  It is a form of theft.

If you use city services, shouldn't you be the one to pay for them?

Do you go to a restaurant and always expect someone else to pick up the tab?

Those who regularly do that are called grifters. Or petty thieves.

Just because the City Council is looking for a free ride and stick it to out of towners to pay the bill/tax, does not make it right.

Stealing is stealing regardless if a majority approves.

Making East Palo Alto visitors pay for services that they will not or cannot use is immoral so Vote NO on Measure V. Better yet, repeal the existing TOT.

And keeping this tax lower will help local hotels compete for business, encouraging more visitors to stay here which would help boost the local economy.

To keep our local hotels competitive, and because stealing from visitors is wrong -

VOTE NO ON MEASURE V.
