I am an experienced trial attorney with almost 20 years experience at the LA County District Attorneys Office, having started as a Certified Law Clerk, then Salaried Law Clerk, before becoming a Deputy District Attorney. I have tried almost every kind of case from misdemeanors to murders and have handled hundreds, if not thousands of cases settling most and taking to trial only those which matter. I am proud of my reputation for being firm, but scrupulosly fair, which is the way I will approach being a judge if I am fortunate enough to be elected.

Alternative sentencing

Do you favor alternative, non-jail sentences for non-violent offenders and what options should be available?

Answer from David A. Berger:

I am the Alternate Sentencing Court ("ACS") Designee for the Airport Branch of the District Attorney's Office where I select and recommend alternate sentencing for defendants charged with non-violent crimes who have an established, proven history of  mental health and/or substance abuse issues, or simply recidivism based on a lack of adequate support mechanisms. This allows me to divert appropriate defendants to programs run by the Second Chance Womens Re-Entry Court, Drug Court, Veterans Court and the Co-Existing Disorders Court. These ASCs provide opportunities for meaningful recovery and rehabilitation and a chance to halt the revolving door that is the reality of the criminal justice system for many. It is not an easy journey, and some do not succeed, however, for those who are serious about turning their lives around, it offers them a real chance to become productive members of society. The ACS is a pioneering approach and I believe its use will expand as it gains momentum.

It is my belief that politics has no place in a court. A judge must be impartial and bear no allegence to any political party or philosophy, treating all who appear in court with neither allegence nor contempt for their beliefs.
